2013 HR Compliance Year In Review

With the holidays behind us, we are now in the countdown to the New Year.  When planning for 2014, we thought we’d recap some items to note from 2013:
  1. The first half of the year, FCRA lawsuits were up more than 23%
  2. 10 states have enacted “Ban the box” legislation
  3. A new “Summary of Rights” went into effect – now there are 3 forms
  4. Three major lawsuits by the EEOC against employers (BMW, Dollar General, Cincinnati Public Schools)
  5. 10 states now limit an employer’s use of credit information for employment
  6. E-Verify announced enhancements to help deter fraud
  7. E-Verify revised their Memorandum of Understanding “MOU”
  8. FBI released Crime in the United States, 2012 report; the estimated number of violent crimes reported to law enforcement increased 0.7 percent over 2011 figures. And the estimated number of property crimes decreased 0.9 percent from 2011—the 10th year in a row that property crimes showed a decline.
  9. 53% of resumes and job applications still contain falsifications
  10. 70% of recent college grads that stated they’d lie on their resume to get the job they want
  11. 78% of resumes are misleading
  12. 40% of applicants inflate salary
  13. According to the Bureau of Labor Statistics Forty-two states had unemployment rate decreases from a year earlier, seven states and the District of Columbia had increases and one state had no change.
  14. FBI background checks on are on the rise. However, a majority of the U.S. population live in states where more than 30 percent of the arrest records in the state criminal records repository do not include information on the final outcome of the case. Because the FBI relies on the states to submit updated records, the result is that the FBI records often lack the final disposition information.
  15. The Internal Revenue Service and the U.S. Department of Labor have increased enforcement efforts with regard to the misclassification of workers as independent contractors.
